The High Court has refused permission to proceed with our legal challengeof the Brockwell Live planning decision. The judge considered that althoughLambeth Council had misrepresented at least three issues, these failings were not enough to justify overturning the planning committee's decision. He made no judgment on whether that decision itself was correct.
It is wrong to say the court approved of holding Brockwell Live commercial events in the park.
Although we have not met the very high bar for proving procedural failure, by taking this action we have made huge steps forward in protecting the park:
🌳 The Council can no longer grant permission without taking proper account of the damage and impact on the park from events in previous and future years.
🌳 The Council has been forced to disclose important information about income from the events and expenditure on the park.
🌳 We are much better able to ensure planning conditions are complied with.
🌳 Council decisions will have to be made with greater transparency and take the park's protections more seriously.
This is what holding the Council to account looks like, and we are very grateful to our supportersin helping us achieve this.
We believe it is possible to hold popular and sustainable events in the park, but ultimately, planning law allows elected councillors to make almost any decision they like. If we think these are damaging and unfair, our best defence is through the ballot box.
Thank you to our supporters for standing with us. Together, we will keep protecting our precious local park.
